Welcome to Motion Texture ("Website"), an online store offering animated textures, stock footage and other digital products for video projects ("Products"). By accessing or using the Website, or purchasing any Product, you agree to be bound by these Terms. Please read them carefully.

1. Digital Products

All products sold on Motion Texture are digital-only and delivered via electronic download. No physical items will be shipped.

2. Payment & Refund Policy

Because digital files cannot be "returned," all sales are typically considered final.
However, Motion Texture offers a 30-Day Satisfaction Guarantee to ensure you're happy with your purchase.

30-Day Satisfaction Guarantee

If you are genuinely unsatisfied with your purchase, you may request a refund within 30 days of delivery.

To help improve the product, I ask that you provide:

A brief explanation of what didn't work for you, and
If possible, an example or screenshot of what you were trying to achieve.

Refund Exclusions

Refunds may not be granted if:

The product has been used in a paid client project after purchase
Multiple refund requests are made across different products
The request appears fraudulent or abusive

3. License & Usage

Upon purchase, you are granted a non-exclusive, non-transferable license to use the Products for personal or commercial projects
You may not:
- Resell the Products
- Redistribute or share the Products with third parties
- Upload the Products to platforms for free or paid distribution
- Claim ownership of the Products
Each purchase is licensed to a single individual or entity only.

4. Product Access & Delivery

After checkout, a download link will be emailed to you.
You are responsible for saving and backing up all files you download.
Each product includes a maximum of five (5) download attempts. If you exceed this limit, contact us at b@motiontextures.com and we'll assist you.

5. Product Compatibility

Please review Product details and software compatibility before purchase.
Ensuring compatibility with your tools (After Effects, Premiere Pro, Final Cut Pro, DaVinci Resolve) is your responsibility.

6. Intellectual Property

All Products remain the intellectual property of Motion Texture.
Your license grants usage as outlined above but does not transfer ownership.

7. Privacy & Data Collection

Personal information is used only for transaction purposes and product delivery.
We collect your email during checkout for transaction purposes and occasional updates.
You may unsubscribe from marketing at any time.
We do not sell or share your data.

8. Limitation of Liability

Motion Texture is not liable for any direct, indirect, incidental, or consequential damages related to the use or misuse of our Products.
Maximum liability is limited to the purchase price of the Product in question.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Website constitutes acceptance of any changes.
